The role of Canadian immigration consultants

Immigration consultants in Canada has a privileged role to play in maintaining the integrity of Canada’s immigration system and the administration of justice. The consultant upholds the rules of law and acts honestly at all times. They are instrumental in giving tools and guidance to those who wish to become permanent residents of Canada and help them follow the legal proceedings confidently.

The consultants provide advice and information to those wanting to stay in Canada about visas, work permits, study permits and their requirements. They help the clients in applying for Canadian Immigration as per their qualifications and consults them about various available programs through which a client can apply to become an immigrant of Canada without any fraud. The consultant completes all the paperwork and communicates with the various immigration offices in Canada on the behalf of the client in a professional manner. He communicates with the client at all times, meets the deadlines, apply his judgement and knowledge, and answer reasonable requests from the clients. He keeps himself informed of the changed/new rules and programs so that he can better guide the clients and provide competitive services.

As the Canadian immigration is open to all from all over the world, it is the duty of the consultant to provide services to all without discriminating on the basis of race, religion, caste and region. It is therefore, the role of the consultant to translate the documents as per the clients need and make him understand the process fully.

The foremost role of the consultant is to understand the client and understand what he needs. Extensive interviewing can facilitate this where a consultant’s role is to ask all the right questions to the client and prepare his profile accordingly. The consultant never encourages the client to provide any fraudulent or misleading information for the benefit of gaining entry into the country.

Consultants play an important role in maintaining the integrity of the immigration system in Canada by providing the correct information to the immigration officers and never assisting the client in any fraudulent or misleading information.

When a client retains a consultant, he/she puts in a lot of faith in their representative; it is consultant’s responsibility to maintain that faith in them by providing correct, timely information and answering their reasonable requests at all times. It is the responsibility of the consultant to inform the client in writing of any communication received from any Canadian immigration office that is related to him.

One of the other important roles of immigration consultants in Canada is to maintain the confidentiality of the clients’ information. The consultant protects all the information provided by the clients at various stages unless authorized by the client. He also ensures the safekeeping of the client’s property in accordance with the law. This role helps in upholding the professional conduct as well as maintaining clients’ trust.

Canadian immigration consultants also play active role in maintaining the national security by carefully interviewing the clients and red flagging the questionable conduct of the prospective immigrants. Sometimes, someone with criminal background may also try to get Canadian immigration but if the consultant asks all the right questions and assesses that the criminality of the client possesses a threat to the national security, he must deny services to such clients. He, by doing so, is able to pre-screen the client even before the immigration officer and justifies his responsibility towards the country and the fellow countrymen!

Every case is unique in itself. The uniqueness and the complexity of the case define as to what the fees would be. The immigration consultant’s role is to charge a fair and reasonable amount of the fees from the client and provide a clear retainer which includes the address and phone number for complaint process, should there be a need. He also keeps the clients monies in trust and uses it only as per the clients’ authority. He also clearly informs the client of the applicable CIC fees and clearly mentions who will be paying that fees to avoid any confusions in the future.

In addition to his roles and responsibilities to the clients, the immigration consultant in Canada also has responsibility towards its licencing authority – ICCRC (Immigration Consultants of Canada Regulatory Council). Any changes in contact information should be notified immediately and any communication from ICCRC should be responded to promptly.

In a nutshell, the immigration consultant in Canada plays, but not limited to, the role of interviewer (getting to know the client better), clerk (filling up the forms as per CIC guidelines), student (keeping informed of the new Canadian immigration programs and laws), border security officer (red-flagging anything threatening to the security of country), accountant (keeping the retainers and maintaining trust accounts) and an honest citizen (not indulging himself in any fraudulent and misleading information) – all at the same time!
