Who can legally immigrate to Canada?
On this week’s blog I will talk about who can legally immigrate to Canada. As we all know Canada is not open to everybody. And of course an expression like “Come To Canada – We are Open” is totally wrong. Canada opens to its doors to experienced skilled professionals, businesspeople, entrepreneurs and temporary workers who are in need. So it ain’t possible to say that Canada is open to everybody.
Especially after the changes that has come to effect on July 1st 2012 we shouldn’t expect huge amounts of immigrants to emigrate to Canada on the upcoming years. There is temporary pause on most Canadian federal immigration streams. A new immigration selection stream will come to effect on early 2013 and we can talk clearly about if Canada is open to experienced professionals or not.
Now let’s have a look at the federal and provincial streams.
Federal Skilled Worker Stream
A limitation in number of intakes and occupations announced on June 2011. Ministry of Immigration reduced the number of intakes to 10,000 and reduced the number of occupational list to 28. Prospects used to wait a new selections stream on July 2012 but the Ministry announced that there will be a temporary pause until early 2013.
Federal Investor Stream
As of July 1, 2012, CIC has temporarily stopped accepting applications for the federal Investor program to focus on processing the applications we already have while the program is reviewed. This pause on new applications will continue until further notice. It does not apply to the Quebec Immigrant Investor Program. (1)
Federal Entrepreneur Stream
CIC has temporarily stopped accepting applications for the federal entrepreneur program. Only applications received before July 1, 2011, will be processed. This suspension will continue until further notice. (2)
Federal Self Employed Person Stream
The only stream that is active at the moment. Recent changes has applied for the applicants. All applicants has to send their applications to Sydney, Nova Scotia. The only improvement to my opinion made in the self-employed person applications. Before outland simplified applications has to be forwarded to the local visa offices. Now all applicants inland/outland can send their regular completed forms to Centralized Intake Office in Sydney, Nova Scotia. This will give faster results people whom applied outside Canada.
Quebec Skilled Worker Stream
Following a decision by the government published in the Gazette officielle du Québec on June 29, 2012, the Ministère de l’Immigration et des Communautés culturelles has suspended the intake of applications for a selection certificate that can be submitted by certain economic immigration candidates.
If You or your accompanying spouse hold a diploma awarded by a teaching institution in an area of training allowing you to get 6 (see list, in French, 38 kb), 12 or 16 points under the area of training criterion of the selection grid for skilled workers (see list, in French, 35 kb). The number of years of study required to obtain your diploma must be at least equal to the number of years required to obtain that diploma in Québec. This diploma was obtained less than five years before the date of your application. Failing that, you must have practised, on a full-time basis and for at least one year out of the five years preceding the date of your application, a profession or trade in an area related to that diploma.(3)
Quebec Business People Streams
Quebec government gave a temporary pause on lately June 2012 to the business people applications. Investors, Entrepreneurs and self-employed people has to wait until March 2013 for the new rules and caps.
Provincial Nominee Programs
Most provinces choose their own immigrants in Canada. And still many provinces accept skilled workers. But a prospect outside Canada has to find a local employer that will hire him/her from that province in order to apply as a skilled worker. And this is almost impossible for many outside Canada.
But the provinces has amazing offers for business people. A prospect that has a management experience 2 or 3 years and who is willing to invest around 100-150ks can immigrate to Canada smoothly. That type of applications require perfect business plans and genuine documents.
My favorite province is Nova Scotia in PNP Business Applications. Its agri-farmer business people stream is very effective. A prospect with 2 year farming practice and who is willing to buy a farm for 100ks can apply for Nova Scotia Farmer Stream. And also the language requirements are pretty low when I reviewed the requirements. Detailed information can be found at http://novascotiaimmigration.ca/
Manitoba, British Columbia, Saskatchewan, Prince Edward Island and New Brunswick PNP streams are also offer acceptable requirements. You can check out provincial application requirements at http://www.cic.gc.ca/english/immigrate/provincial/index.asp
Who else can immigrate ?
Students who are already in Canada and graduated or studying their PHDs have a chance to apply for the Canadian Experience Streams. This applies for the prospects who has completed 2 years of full time studies as well.
Temporary Workers who has worked full time in Canada for two years may receive their immigration status as well.
As clearly discussed Canada is not open for everybody. Especially it is not open at the moment for many. But who knows with 2013 we can see a new immigration system that may allow more people to come to Canada.
And let’s remember the famous saying one more time “Moving and living in Canada is not a right, it is a privilege”
